Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Trendline website at trytrendline.com and the related applications, tools, and services (together, the “Service”). The Service is operated by LevelUp Technologies LLC, a North Carolina limited liability company (“LevelUp,” “we,” “us,” or “our”).

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you are legally permitted to access sports-analytics tools where you live. You are solely responsible for complying with all laws that apply to you, including any laws governing sports wagering in your jurisdiction.

2. Accounts

To use most features you must create an account with a valid email address and password. You agree to provide accurate information and to keep it current. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at help@trytrendline.com if you suspect unauthorized use. You may not share your account or transfer it to anyone else without our consent.

3. Subscriptions, Billing & Refunds

Subscription plans

The Service is offered on a recurring subscription basis. When you subscribe, you authorize us and our payment processor to charge your payment method the then-current subscription fee, plus any applicable taxes, on a recurring basis (for example, monthly or annually) until you cancel.

Automatic renewal

Your subscription renews automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date. We may change subscription prices from time to time; any price change will apply to billing periods that begin after we notify you.

Payment processing

Payments are processed by Stripe, Inc. We do not store your full payment card details. Your use of Stripe’s services is subject to Stripe’s own terms and privacy policy.

All sales are final — no refunds

Cancellation

You may cancel your subscription at any time from your account settings or by contacting help@trytrendline.com. When you cancel, your subscription remains active until the end of the current paid billing period, after which it will not renew and you will lose access to paid features. Because all sales are final, you will not receive a refund for the remainder of the current period.

Free trials and promotions

If we offer a free trial or promotional rate, we will disclose its terms at sign-up. Unless you cancel before the trial ends, your subscription will convert to a paid plan and your payment method will be charged automatically.

4. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation, including laws governing sports wagering;
• scrape, harvest, resell, redistribute, or commercially exploit the Service’s data, models, or content except as expressly permitted;
• reverse engineer, decompile, or attempt to extract the source code or underlying data of the Service;
• interfere with, disrupt, or place undue load on the Service or its infrastructure, or circumvent any access or usage limits;
• access the Service through automated means (bots, scrapers) except via any API we expressly provide; or
• use the Service to build or train a competing product or dataset.

5. Intellectual Property

The Service, including its software, design, text, statistics presentations, and the “Trendline” name and logo, is owned by LevelUp Technologies LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes in accordance with these Terms.

Models, filters, and configurations that you create using the Service (“Your Content”) remain yours. You grant us a non-exclusive license to host, store, and process Your Content solely to operate and improve the Service. Underlying sports statistics and data may be sourced from third parties and remain subject to their rights.

6. Informational Purpose & No Advice

Trendline is an analytics and information tool. It lets you build, save, and receive alerts about sports models based on statistical data. It does not provide gambling, betting, financial, investment, tax, or legal advice, and nothing in the Service is a recommendation to place, or a solicitation to place, any wager or bet.

Sports outcomes are inherently uncertain. Past performance and historical trends do not guarantee future results. Any alert, model output, projection, or statistic is provided for your independent evaluation only. You are solely responsible for any decisions you make and any consequences that follow, including any financial loss. If you choose to wager, you do so entirely at your own risk and are responsible for ensuring it is legal where you are.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, completeness, reliability, or timeliness of any data, statistic, model, or alert. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data is accurate or up to date. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

8. Limitation of Liability

To the maximum extent permitted by law, LevelUp Technologies LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or gambling or betting losses, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $100.

9. Indemnification

You agree to indemnify and hold harmless LevelUp Technologies LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 5–9 and 12) will survive. Consistent with Section 3, termination does not entitle you to a refund.

11. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief where appropriate.
